LEGALLY SPEAKING: Minimizing the Legal Pitfalls of Sustainable Design and
Construction (Part 2)
In the May-June 2011 issue, we identified some of the ways to minimize the
potential legal risks of sustainable design and construction. These included:
(1) Don’t Promise More Than You Can Deliver, which really focuses on your
marketing activities and warranties; (2) Don’t Guarantee a Level of
Certification, unless it is somehow required by law; (3) Identify the
Participants, Their Roles, and Their Responsibilities, which will help you
through the design and construction process; (4) Clarify the Standard of Care,
which is important from a negligence viewpoint in determining liability; and (5)
Only Take Responsibility for Delays You Can Control, since delays on a green
project can stem from any number of reasons. In this second of the two-part
series, we look to five more ways to minimize the legal pitfalls on a green
project.

Construction Backlog Grows 4 Percent in First Quarter of 2011
Associated Builders and Contractors (ABC) today reports that its Construction
Backlog Indicator (CBI) for the first quarter of 2011 averaged 7.3 months, a 4
percent increase from 7.1 months during the fourth quarter of 2010, and up from
6.1 months, or an increase of 21 percent, from one year ago. CBI is a
forward-looking indicator that measures the amount of construction work under
contract to be completed in the future.

Cost Trends
Construction Cost Trends for 2011
After an 8% slide over the last 12 months, it appears that housing may finally
be bottoming out. We’ve said this before but delinquencies on home mortgages are
lessening and, as a result, foreclosures will slow down. Once the foreclosed
houses are cleared out, we should finally see an increase in new home
construction. Don’t count on it right now but watch for improvement over the
next 6 months. Overall, construction spending is down 7% with some segments
showing slight signs of life.
