Some
Construction Documents Are Not Contract Documents
It’s Important to Know the Difference

There
would be fewer disputes and less disappointment in the construction industry if
all parties to construction contracts clearly understood their obligations and
were fully aware of their obligations, rights, and privileges. These are to be
found primarily in the contract documents. The term contract documents is
uniformly used in all AIA standard form agreements to designate the group of
documents that comprise the construction contract between the owner and
contractor. The terms contract documents and contract may be used
interchangeably.
The contract represents the entire and integrated
agreement between the parties.

While construction projects rarely progress in an ideal fashion, those in the
construction industry easily can define a perfect project. First, work always
begins on time. The contractor performs its work on schedule and within budget.
No unexpected or unforeseen events arise, so the contractor does not ask the
owner for additional money. The owner does not ask the contractor to perform
additional work, and the architect provided a perfect design. The contractor
completes the project on time and precisely according to plan. What’s more, the

Cost Trends
Construction Cost Trends for 2008
One year later and the same story. Housing continues its slide with an
increasingly steep decline of 25-30%. Commercial and Public construction still
offset the shortfall, but not as much as before with combined construction
spending down 5%. In commercial, the lodging industry still leads the pack with
an increase of close to 50% (but down from 60%), with office construction at 20%
(down from 30%).
